All comment cards regarding items must be submitted prior to the Call to Order at 6:30 p.m. During a Special Meeting, the Board shall provide the public with an opportunity to address the Board on any item described in the agenda before or during consideration of that item. Speakers are requested to limit comments to three (3) minutes. After two minutes, the speaker will be notified that he/she has one minute remaining. Please note that, in accordance with Board Policy #9324, all meetings are televised or recorded. (Reference: The Ralph M. 4.1. Riverside County Board of Education's Approval of District's Renewable Energy Bonds and Certificates of Participation (Guillen)
Rationale:

Riverside County Office of Education has reviewed and approved the District's 2017 Municipal Lease, totaling $10 million dollars, and the projected 16 million dollars of savings in utility costs.

4.2. Resolution No. 16-17-12: To Adopt Certain Findings And Approve The Energy Services Contract Between District And Opterra Energy Services, Inc. For Design, Installation, Operation And Maintenance Of Solar Photovoltaic Systems On Selected District Sites (Guillen)
Rationale:

OpTerra has proposed an Energy Services Contract (“Solar Contract”) to the Banning Unified School District (“District”) under which OpTerra will construct, install, operate and maintain photovoltaic systems on selected District sites to generate solar energy to support the District’s acquisition of cost-effective energy.  Pursuant to Government Code section 4217.10 et seq., the District may enter into the Solar Contract if the Board finds that the cost of the energy purchased under the Solar Contract is projected to be less than the anticipated cost of energy in the absence of the Solar Contract. The Board made the above cost-savings finding following a hearing at its regularly scheduled meeting on April 6, 2017, notice of which was provided two weeks in advance in accordance with Government Code section 4217.12.

Entering into the Solar Contract and authorizing OpTerra to construct, install, operate and maintain the Solar Project will result in annual savings in energy costs to the District and will accomplish one of the District’s goals, to improve the operational efficiency of the District’s facilities.
